Discord App Terms of Service

These terms govern your use of the unused.market Discord application (the "App"): the bot used on the unused.market Discord server to verify members and to run support tickets. They are an agreement between you and Dominik Wójtewicz, a natural person operating unused.market as unregistered activity (działalność nierejestrowana) under Article 5 of the Polish Entrepreneurs' Law, Al. Solidarności 68/121, 00-240 Warszawa, Poland ("we", "us").

By authorising the App, completing verification or opening a ticket, you accept these terms. If you do not accept them, do not use the App.

The unused.market website and API are governed by their own Terms of Service. Your use of Discord is governed by Discord's Terms of Service and Community Guidelines, which continue to apply to you.

01What the App does

1.1. Verification. The App checks that an account joining the server belongs to a person and not to an automated account, and gives verified accounts the member role.

1.2. Tickets. The App opens a private channel between you and the unused.market support team, and closes it when the matter is done.

1.3. The App is free. It is provided for the unused.market server only and is not offered for use on other servers.

02Using the App

2.1. You must meet Discord's minimum age and be allowed to use Discord in your country.

2.2. You must not:

try to get past verification with automation, scripts, solving services, or accounts that are bought, borrowed or stolen;
use more than one account to evade a ban or a failed verification;
open tickets to spam, harass, threaten, advertise or waste the team's time;
post unlawful content, malware, or other people's personal data in a ticket;
impersonate unused.market staff or another person;
probe, overload, reverse engineer or interfere with the App.

2.3. Do not post passwords, API keys, card numbers or identity documents in a ticket. Staff will never ask for your password or your API key. Anyone who does is not staff. We are not responsible for what you lose by sharing secrets on Discord.

03Tickets and support

3.1. Support through tickets is given as a courtesy. We do not promise a response time, a resolution, or that tickets are available at any particular moment.

3.2. Nothing said in a ticket changes the Terms of Service of the unused.market website and API, and no statement by a moderator or support agent is a binding promise unless we confirm it by email from contact@unused.market.

3.3. Tickets are recorded. A transcript is kept as described in the Discord App Privacy Policy.

3.4. Anything about your account balance, payments or payouts that needs to be on record should also be sent to contact@unused.market.

04Moderation

We may refuse verification, remove the member role, close or delete a ticket, and mute, kick or ban any account, at any time and at our discretion, in particular for breaking these terms, the server rules, or Discord's rules. We may report accounts to Discord.

05Availability and changes

The App depends on Discord and on our own hosting. It may be slow, wrong, unavailable or withdrawn at any time, and we may change what it does without notice. A verification that fails by mistake can be reviewed by a moderator.

06No warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT VERIFICATION WILL STOP EVERY AUTOMATED OR MALICIOUS ACCOUNT, THAT OTHER MEMBERS OF THE SERVER ARE WHO THEY SAY THEY ARE, OR THAT ANY TICKET WILL BE ANSWERED OR RESOLVED.

07Limitation of liability

7.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM THE APP OR THE SERVER, INCLUDING: BEING REFUSED VERIFICATION, MUTED, KICKED OR BANNED; ANYTHING ANOTHER DISCORD USER SAYS, SENDS OR DOES, INCLUDING SCAMS, PHISHING AND IMPERSONATION; ANYTHING DISCORD DOES OR FAILS TO DO; SECRETS OR PERSONAL DATA YOU POSTED YOURSELF; AND DELAYS OR ERRORS IN SUPPORT.

7.2. WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL LOSS, OR FOR LOSS OF PROFIT, REVENUE, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR EVERYTHING CONNECTED WITH THE APP IS LIMITED TO USD 50.

7.3. Nothing in these terms excludes liability that cannot be excluded by law, including liability for damage caused intentionally. If you are a consumer, the mandatory consumer-protection rules of your country of residence apply and prevail over anything here that conflicts with them.

08Your content

You keep whatever rights you have in what you post. You allow us to store, read and reproduce what you post in a ticket for the purpose of handling it and keeping the record described in the Discord App Privacy Policy.

09Ending use

You can stop using the App at any time by leaving the server and removing its authorisation in Discord under User Settings, Authorized Apps. We can end your access at any time under section 4.

10Governing law

These terms are governed by the laws of Poland. The Polish courts with jurisdiction over the operator's place of residence, Warsaw, have exclusive jurisdiction, subject to section 7.3.

11Changes

We may change these terms. The new version is posted with a new effective date and material changes are announced on the server. Using the App after a change means you accept it.
